1. PowerDial is software

PowerDial provides software tools for outbound sales workflows, including dialing, campaigns, contacts, follow-up, reporting, and related sales-operation features.

2. Founder license

A PowerDial Founder purchase is a software-license purchase. It is not equity, ownership in PowerDial, a security, an investment product, or a promise of financial return.

The Founder license includes one Founder seat with lifetime access to the PowerDial software platform for that included seat, subject to these Terms and continued compliance with applicable laws and platform rules.

3. Lifetime license scope

“Lifetime” refers to the lifetime availability of the PowerDial software product or successor service made available under the Founder program. It does not mean that every third-party service, telecom expense, usage-based service, premium integration, or future add-on is included without additional charge.

4. Usage and pass-through costs

Telecom usage, phone numbers, SMS, AI services, Google or other API usage, additional seats, premium integrations, and other usage-based or third-party hard costs may be charged separately.

Additional seats are separately licensed at the price offered when those seats are purchased.

5. No free trial

Founder access is a paid software-license purchase. PowerDial does not promise or include a 30-day free trial as part of the Founder offer.

6. Acceptable use

You are responsible for using PowerDial lawfully. You may not use the platform for fraud, harassment, impersonation, unlawful robocalling, unlawful telemarketing, prohibited spam, or any other activity that violates applicable law or third-party rights.

You are responsible for your own calling practices, consent requirements, calling hours, do-not-call compliance, caller-ID usage, and other rules that apply to your business.

7. Account responsibility

You are responsible for safeguarding your account credentials and for activity performed through your workspace. Seats may not be shared in a way that defeats account limits or licensing rules.

8. Service availability

PowerDial depends in part on third-party infrastructure, including telecommunications, hosting, payment, browser, and API providers. Continuous or error-free operation cannot be guaranteed.

9. Changes to the platform

PowerDial may improve, replace, reorganize, or retire individual features as the product evolves. Founder status does not guarantee that every current feature, vendor, integration, or workflow will remain unchanged forever.

10. Suspension and termination

PowerDial may suspend or terminate access for fraud, abuse, unlawful activity, security threats, nonpayment of separately billed hard costs, or material violations of these Terms.

11. Refunds and disputes

Founder purchases are software-license purchases. Any refund, cancellation, chargeback, or payment-dispute rights are subject to the checkout terms, applicable law, and any written refund policy presented at the time of purchase.

12. Disclaimer

PowerDial is a sales-productivity tool. It does not guarantee sales, appointments, revenue, conversion rates, deliverability, caller-ID reputation, or business results.
